The Uttar Pradesh News Desk Bench said that in terms of section 243-u of the Constitution should be elected before the end of the tenure of the bodies, although it may take a long time to perform a threefold test, so that the democratic form of the bodies must keep strong and keep the constitutional provisions in mind. The court also arranged that if the term of office of a body ended before the election, the Committee of the District Magistrate, Executive Officer or the Municipal Commissioner and the District Magistrate, the committee of any officer nominated at the district level will be seen by the daily body. The said committee has no right to make any important policy decision. The court ordered with regard to the triple test that when the dedicated committee is formed to study the nature and implications of backwardness with the aim of providing reservation to backward class citizens in the election of bodies, when the said committee transgenders should consider the claims of the inclusion of themselves in the backward classes. The State Government issued the above draft notice using the powers that proposed in section 9-A (5) (3) of the UP Municipalities Act, 1916, which made objections in the civil election, for reservation for SC, ST, backward and women’s classes.
