The Supreme Court of India granted a week’s time on Thursday to submit an answer to the petitions that disputed the constitutional validity of WAQF (Amendment Act, 2025. WAQF or WAQF -Directions will not be made. (SG), Tushar Mehta, who proposed the trade union government, said that the center wanted to place an answer within seven days. “WAQF, including WAQF by the user who has already been registered or declared through notice, may not be indicated, or the collector will change. We are taking the statement on record,” he said, as quoted by Legal News website Livelaw on Wednesday, the three-judging bank set to determine the interim order, which appeared for the center. The bank then said it would hear the case again on April 17 before passing orders. During the hearing, the court expressed concern about three provisions in the amended law, while he suggested that it be able to remain these parts of the controversial law. These three parts include the concept of ‘waqf-by-user’, the representation of non-Muslims on WAQF boards, and the powers of the collector to change the status of disputed WAQF soil. “We do not remain a legislation at this stage of the challenge unless in exceptional circumstances is an exception. Our concern is that if WAQF-By user is disposed, there can be major consequences,” Chief Justice of India Sanjiv Khanna said in an oral observation. The WAQF (Amendment Act), 2025, which came into effect earlier this month, was disputed by a group of petitions. The Lok Sabha and the Rajya Sabha approved the bill during the recently secluded budget session of Parliament. President Droupadi Murmu gave her permission for the proposed law on April 5.
